Welcome to Brusite (“Brusite,” “we,” “us,” or “our”). By accessing or using our website at brusite.com, our mobile application, or any of our services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use our Services.
1. About Brusite
Brusite is a proxy-shopping and cross-border e-commerce platform based in Brunei Darussalam. We enable international buyers to purchase authentic Brunei products from verified local sellers. Brusite acts as an intermediary — we facilitate purchasing, conduct quality inspections at our warehouse, and arrange international shipping on behalf of buyers.
2. Eligibility
- You must be at least 18 years old (or the age of majority in your jurisdiction) to use our Services.
- By creating an account, you represent that all information provided is accurate, current, and complete.
- You are responsible for maintaining the confidentiality of your account credentials.
- One person may not maintain more than one active buyer account without our prior written consent.
3. How Brusite Works
Brusite operates as a proxy purchasing and forwarding service:
- Browse & Order: You select products listed by verified Brunei sellers on our platform and place an order.
- We Purchase: We purchase the item(s) from the seller on your behalf within Brunei.
- Quality Inspection: Items are received at our warehouse, inspected for quality, condition, and accuracy.
- International Shipping: We package and ship items to your international address using our logistics partners.
Brusite is not the seller of third-party products. We act as an agent facilitating the purchase and delivery. Product listings, descriptions, images, and pricing are provided by individual sellers.
4. Account Responsibilities
- You must provide a valid email address and accurate personal information.
- You are solely responsible for all activity under your account.
- Notify us immediately at hello@brusite.com if you suspect unauthorised access.
- We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraud, or abuse our Services.
5. Orders & Payments
5.1 Pricing
- All prices are displayed in Brunei Dollars (BND / B$) unless otherwise indicated.
- Prices include the product cost as listed by the seller. Shipping fees, handling fees, and applicable taxes are calculated separately at checkout.
- Brusite reserves the right to charge a service fee (commission) for proxy purchasing services.
5.2 Payment Methods
- We accept payment via bank transfer (BIBD, Baiduri), mobile banking, and Brusite Pay wallet.
- All payments must be made in full before we process your order.
- Wallet top-ups are credited instantly and are non-refundable except where required by law or our Refund Policy.
5.3 Order Confirmation
- An order confirmation does not guarantee product availability. If a product becomes unavailable, we will notify you and issue a full refund.
- We reserve the right to cancel orders that we suspect are fraudulent, duplicative, or placed in violation of these Terms.
6. Shipping & Delivery
- International shipping rates are calculated based on destination country, package weight, and dimensions.
- Estimated delivery times are provided for reference only and are not guaranteed. Delays may occur due to customs processing, weather, carrier issues, or other circumstances beyond our control.
- Customs, duties, and import taxes are the responsibility of the buyer. Brusite is not responsible for any customs charges levied by your country.
- Brusite is not liable for items seized, delayed, or destroyed by customs authorities.
- All shipments include tracking numbers. Risk of loss transfers to you upon handover to the shipping carrier.
7. Quality Inspection
- All items are inspected at our Brunei warehouse before international shipping.
- We verify the item matches the order (correct product, quantity, and general condition).
- We do not guarantee the functionality, authenticity, or merchantability of third-party products beyond visual inspection.
- If an item fails inspection (damaged, incorrect, or materially different from listing), we will notify you and offer a refund or replacement per our Refund Policy.
8. Brusite Pay Wallet
- Brusite Pay is a prepaid digital wallet for use on our platform.
- Wallet balances are stored in BND and can be used for purchases and services on Brusite.
- Wallet funds are non-transferable to other users and cannot be withdrawn as cash except where required by applicable law.
- Daily check-in rewards are promotional credits subject to change or discontinuation at any time.
- Brusite reserves the right to suspend wallet access if suspicious activity is detected.
9. Seller Terms
- Sellers on Brusite must be registered businesses or individuals based in Brunei Darussalam.
- Sellers are responsible for the accuracy of their product listings, pricing, stock availability, and compliance with Brunei law.
- Brusite charges a commission on completed sales. Rates are disclosed in the Seller Dashboard.
- Sellers must fulfill orders within the timeframe specified in our Seller Agreement.
- Brusite reserves the right to remove listings or suspend seller accounts that violate our policies.
10. Prohibited Items
The following items may not be listed or purchased through Brusite:
- Illegal drugs, narcotics, or controlled substances
- Weapons, firearms, ammunition, or explosives
- Counterfeit, pirated, or stolen goods
- Hazardous materials (flammable, radioactive, toxic)
- Live animals or protected wildlife products
- Pornographic or obscene materials
- Items prohibited by Brunei law or the destination country’s import regulations
- Items that infringe upon intellectual property rights
11. Intellectual Property
- All Brusite branding, logos, website design, software, and original content are the property of Brusite and are protected by copyright and trademark laws.
- You may not reproduce, distribute, modify, or create derivative works from our content without express written permission.
- Sellers retain ownership of their product images and descriptions but grant Brusite a non-exclusive licence to display and promote them on our platform.
12. Limitation of Liability
- Brusite provides the platform and proxy services “as is” without warranties of any kind, express or implied.
- To the maximum extent permitted by law, Brusite shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services.
- Our total liability for any claim shall not exceed the amount you paid to Brusite for the specific transaction giving rise to the claim.
- Brusite is not responsible for the quality, safety, legality, or accuracy of items sold by third-party sellers.
13. Dispute Resolution
- If you have a dispute with a seller, please contact us at hello@brusite.com. We will mediate in good faith.
- Buyer Protection claims must be filed within 14 days of delivery (or 30 days of the estimated delivery date for non-receipt).
- If we are unable to resolve a dispute amicably, it shall be governed by the laws of Brunei Darussalam and submitted to the exclusive jurisdiction of the courts of Brunei Darussalam.
14. Privacy
Your use of Brusite is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.
15. Modifications
We may update these Terms at any time. Material changes will be communicated via email or a prominent notice on our website. Continued use of our Services after changes constitutes acceptance of the updated Terms.
16. Termination
We may suspend or terminate your access to our Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services ceases immediately. Sections that by their nature should survive termination shall remain in effect.
